1. Who we are

This website, skinklean.co, is operated by Skinklean LLC, a limited liability company registered in Delaware, USA, doing business as SkinKlean ("SkinKlean", "we", "us", "our").

By using this website or placing an order, you agree to these Terms of Service and to the policies they include by reference: our Refund Policy, Shipping Policy, Subscription Policy and Privacy Policy. If these Terms and one of those policies conflict on a specific topic, the policy for that topic applies.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order.

3. Products and information

  • Our products are cosmetics. They are not medicines and are not intended to diagnose, treat, cure or prevent any disease.
  • Results vary from person to person. Please read the directions and ingredient list on the packaging before use, do a patch test first, and stop using a product if irritation occurs. If you're pregnant, breastfeeding or have a skin condition, check with your doctor first.
  • We work to keep product information, images and prices accurate. If we find an error, including a pricing error, we may correct it and, if your order is affected, we'll contact you before shipping and offer you a full refund if you prefer to cancel.

4. Orders, prices and payment

  • Your order is an offer to buy. The contract is formed when we send your shipping confirmation email. We may decline or cancel an order (for example, suspected fraud, stock issues or pricing errors); if we do, we'll refund you in full.
  • Prices are shown at checkout in your local currency and include or exclude taxes as indicated there. Shipping costs, duties and taxes are explained in our Shipping Policy.
  • Payment is taken when you place your order. Accepted methods are listed on our Payment Policy page.

5. Subscriptions and automatic renewal

If you choose a subscription, it renews automatically and your payment method is charged at the price and frequency shown at checkout until you cancel. You can skip, delay or cancel online at any time in your customer portal. The full terms are in our Subscription Policy.

6. Guarantee, returns and cancellations

Our 30-Day Money-Back Guarantee, returns of unopened products and order cancellations are covered by our Refund Policy and Order Cancellation Policy.

7. Delivery, title and risk

Delivery times are estimates. Ownership and risk of loss pass to you when the order is delivered to the address you gave us. Lost, stolen and damaged parcels are handled as described in our Shipping and Refund Policies.

8. Reviews, messages and marketing

  • If you submit a review, photo or video, you confirm it reflects your genuine experience and you grant us a non-exclusive, royalty-free right to display it on our website and marketing. We may moderate content that is unlawful, abusive or unrelated to the product, but we don't remove reviews just because they're negative.
  • If you sign up for email or SMS messages, you can unsubscribe at any time using the link in any email or by replying STOP to any text. Consent to marketing is never a condition of purchase. Message and data rates may apply.

9. Use of the website

You agree not to use this website for any unlawful purpose, to interfere with its security or operation, to scrape it, or to submit false information. All content on this website, including text, images, logos and videos, belongs to SkinKlean or its licensors and may not be copied without our permission.

10. Third-party services

Our store runs on Shopify and uses third-party services for payments, subscriptions, reviews and delivery tracking. Their use is subject to their own terms. We aren't responsible for third-party websites linked from ours.

11. Limitation of liability

To the fullest extent permitted by law, SkinKlean is not liable for indirect, incidental or consequential damages arising from your use of this website or our products, and our total liability for any claim related to an order is limited to the amount you paid for that order. Nothing in these Terms excludes or limits liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, for fraud, or under your statutory rights as a consumer. If you are a consumer in the EU or the UK, we are also responsible for loss that was a foreseeable result of our breach of these Terms, and you have the legal rights for goods that are faulty or not as described.

12. Disputes and arbitration (United States)

Please read this section carefully: it affects your legal rights. If you live in the United States:

  • Talk to us first. Before starting any claim, email help@skinklean.co with a description of the issue. Most problems are solved this way. If we can't resolve it within 30 days, either of us may start arbitration.
  • Individual arbitration. Any dispute arising out of these Terms, our products, your orders or this website will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, instead of in court. Either of us may still bring an individual claim in small claims court.
  • No class actions. You and SkinKlean each waive the right to a jury trial and to bring or take part in any class, collective or representative action or arbitration. If this waiver is found unenforceable for a particular claim, that claim will be decided in court, not in arbitration.
  • Opting out. You can opt out of this section by emailing help@skinklean.co with the subject "Arbitration opt-out" within 30 days of your first order.

This section does not apply to consumers in the European Union or the United Kingdom.

13. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. If you are a consumer living in the European Union or the United Kingdom, you also keep the protection of the mandatory consumer laws of your country of residence, and you may bring claims in your local courts.

14. Changes to these Terms

We may update these Terms from time to time. The version in force when you place an order applies to that order. Material changes affecting active subscriptions will be emailed to you before they take effect.

15. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a right isn't a waiver of it. We aren't responsible for delays caused by events beyond our reasonable control.
